To increase housing diversity and support succession planning in rural areas, Council is proposing to amend the Tamworth Regional Local Environmental Plan 2010 (TRLEP 2010) to permit the construction of secondary dwellings with consent in certain areas of RU1 Primary Production and RU4 Primary Production Small Lots land uses zones.

To minimise land use conflict with important agricultural land, the planning proposal proposes to permit secondary dwellings away from identified agricultural land, including the proposed Namoi Regional Jobs Precinct as shown in the link below.

In rural areas where a secondary dwelling is proposed to be permitted with consent, they can only be undertaken in conjunction with another dwelling (the principal dwelling) and would be subject to the following principal development standards under Clause 5.5 of the TRLEP 2010:

  • Secondary dwellings must not exceed either 130m2 or 25% of the total floor area of the principal dwelling (whichever is the greater); and
  • The distance between the secondary dwelling and the principal dwelling must not exceed 100m.

    Under the TRLEP 2010, secondary dwellings are already permitted in the following zones:

  • RU5 – Village;
  • R1 – General Residential;
  • E1 – Local Centre; and
  • C3 – Environmental Management.
  • In addition, State Environmental Planning Policy (Housing) 2021 permits secondary dwellings in all residential zones, including the following:

  • R2 – Low Density Residential; and
  • R5 – Large Lot Residential.
